                                           REPEAL THE TOP TWO CANDIDATE OPEN PRIMARY ACT

PRESS RELEASE:         FOR IMMEDIATE RELEASE
SUBJECT:                     CHALLENGE TO CALIFORNIA’S TOP TWO CANDIDATES OPEN PRIMARY ACT

A CHALLENGE TO THE STATES TOP TWO ACT IS BEING PURSUED BY THE FOUNDATION TO STOP TOP 2 LLC.   THE FOUNDATION SEEKS TO PLACE THE INITIATIVE TO REPEAL ON THE 2018 BALLOT.

THE TOP TWO CANDIDATES OPEN PRIMARY ACT WAS PROPOSED BY THE STATE ASSEMBLY AND ENACTED IN 2011.  THE ACT PERMITS ONLY THE TOP TWO CANDIDATES WITH THE MOST VOTES IN THE PRIMARY ELECTION TO MOVE ON TO THE GENERAL ELECTION, MEANING THAT NO OTHER CANDIDATES APPEAR ON THE GENERAL ELECTION BALLOT.  THE ACT EFFECTS STATE ASSEMBLY, STATE SENATE, HOUSE OF REPRESENTATIVES, AND U.S. SENATE RACES.

“THIS IS A BAD LAW!” ACCORDING TO TOM PALZER, STATE COORDINATOR FOR THE REPEAL OF THE TOP TWO.  “THE FOUNDATION SEEKS SUPPORT FOR THE INITIATVIE TO REPEAL ACROSS PARTY LINES, INCLUDING NPP VOTERS.  DETAILS ON THE INITIATIVE APPEAR ON THE FOUNDATION’S WEBSITE AT:  WWW.STOPTOP2.COM.  THE SITE INCLUDES A SUMMARY OF THE REPEAL AND A NUMBER OF DOCUMENTS THAT CAN BE DOWNLOADED, INCLUDING A ‘DECLARATION OF CIRCULATOR’ FORM REQUIRED TO BE SIGNED IN ORDER TO CIRCULATE PETITIONS AND A ‘CONTRIBUTION’ FORM.  CONTRIBUTIONS CAN BE MADE ONLINE.  SINCE THE INITATIVE IS A CONSTITUTIONAL AMENDMENT, A MINIMUM OF 585,407 SIGNATURES IS REQUIRED TO PLACE IT ON THE 2018  BALLOT.

SUPPORTERS OF THE ACT THAT CREATED THE TOP TWO CLAIMED THAT THE ACT WOULD RESULT IN ‘MORE MODERATE’ CANDIDATES FROM WHICH TO CHOOSE.  INSTEAD, BASED ON DATA FROM THE ELECTIONS OF 2012, 2014 AND 2016, ‘MORE LIBERAL’ OFFICEHOLDERS AND CANDIDATES EITHER RETAINED THEIR SEATS OR WERE ELECTED.
